MEDIA RELEASE FORM
This letter agreement (the agreement) confirms the terms on which You agree to allow Collection Pot to use, for the purposes set out below, the Media collected at the Event.
The following definitions and rules of interpretation apply in this agreement:
‘Collection Pot’ means COLLECTION POT LIMITED, incorporated and registered in England & Wales, with company number 10554265, whose registered office is at 22-24 Harborough Road Kingsthorpe, Northampton, United Kingdom, NN2 7AZ.
‘Event’ means a ‘wedding show’ interview and video recording with Collection Pot.
‘Media’ means any and all media collected at the Event, including but not limited to your name, voice, likeness, photographs, written materials, and audio-visual recordings and footage.
‘Specified Activities' means the use of the Media individually or in conjunction with other media in any medium, including without limitation to print publications, digital publications, and/or public broadcast both online and offline.
‘Specified Purpose’ means the promotional purposes of the Collection Pot in the United Kingdom.
‘You’ means the individual entering into this media release form, the name and signature of which appear below.
Pursuant to and in consideration of the mutual obligations given hereunder, you confirm as set out hereunder.
1. You grant Collection Pot permission to:
1.1 record the Media;
1.2 edit copy, exhibit, publish and/or distribute the Media; and
1.3 otherwise use the Media for the Specified Activities and for the Specified Purpose.
2. Collection Pot hereby agrees to, and you acknowledge that, Collection Pot:
2.1 is the controller and responsible for the personal data comprising the Media and your contact details and any related personal data;
2.2 will process the Media and your contact details and any related personal data in accordance with the privacy notice which can be found here https://www.collectionpot.com/privacy/, receipt of which You acknowledge by signing this agreement; and
2.3 the following additions will apply to the privacy notice:
(a) our Privacy Notice contains important information about how we collect and use your personal data when you use and interact with this website, communicate with us (via the website, on any social media campagin or any other method) and use our Services.
(b) ‘Identity Data’ also includes “orders made by you, your interests, preferences, feedback and survey or social media campagin responses”.
(c) ‘Your interactions with us’ also includes “engaging in any social media campagin, including the intereaction with or recording of any on-street video recordings”.
(d) in the table on ‘WHY DO WE USE YOUR PERSONAL DATA?’ the ‘Purpose/Use’ also “includes to enable you to partake in a prize draw, competition or complete a survery or partake in a social media campagin”.
3. In relation to the Media, You:
3.1 grant Collection Pot a non-exclusive right to use, record, photograph, reproduce, distribute and display the Media for the Specified Activities and the Specified Purpose;
3.2 warrant, undertake and confirm to Collection Pot that You are the sole, absolute unencumbered, legal and beneficial owner of, and owns all the rights and interests in the Media or, where You are not, have a valid and subsisting licence for the content of the Media in order to enter into and grant this media release; and
3.3 confirm that You are over eighteen years of age and am competent to contract in your own name insofar as the above is concerned. If You are under eighteen years of age, your parents or legal guardians have read this document and have given their consent by signing below.
4. This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation) shall be governed by and construed in accordance with the law of England and Wales.
5. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
